Know all men by these presents that I, Jesse Brady, of the Town of New Castle in the County of Westchester and State of New York, being weak in body but of a sound disposing mind and memory thanks be to God for it, and as touching worldly estate that I have been blest with in this uncertain world, do make and publish this to be my last Will and Testament in manner and form following: (that is to say)
First, I will that all my just debts and funeral charges be paid and discharged by my Executors herein after named.
Secondly, I do give and bequeath unto Jemima, my welll beloved wife as much of my household furniture as she is a mind to have.
I do order and direct my Executors herein after named, to take in charge the three notes that was executed by Gilbert Martin to me payable on the first day of May next for the sum of two hundred dollars each, or the monies when paid for the same, and put the same at use and pay so much to my daughter, Rhoda Brady, for the support and reasonable education of her child that she is now got, as my said executors, herein after named shall think proper, and when my said Rhoda Brady's child arrives to the age to take care of itself and has got his reasonable education for my said executors, herein after named, to put at use such part of the said residue of the said monies that may remain in their hands of the avales of the above said three notes as they may think proper for to be paid to my above said Daughters child when he arrives at lawful age, and such part of the above said avales of the said three notes as my said Executors shall think proper, to turn in and divide with the rest of my estate between all my children.
I do authorise and fully empower my said executors, herein after named, to sell all my real estate or landed property and convey the same as soon after my death as they shall think proper, to be left at their discretion to sell and convey any time after my Death as they may think best at Public or Private sale.
I do likewise authorise and fully empower my said Executors herein named to sell all the residue and remainder of my personel or moveable estate of any nature or kind soever at Public or private sale as they may think best.
I do order my said Executors herein after named to put at Intrest with taking sufficient security the one equal half of the residue of my estate after my debts and funeral charges is paid, and the intrest paid to Jemima, my well beloved wife during the term of her natural life which said intrest of the above said sum, I do give unto my beloved wife In Lieu of her dower right in my estate or landed property.
I do give and bequeath the other half of the avales of my estate among or between my twelve children, to be divided equally share and share or their heirs including the out sets and monies and obligations were I stand bound for any of them to be considered as apart of their legacy, not reckong any intrest from the time they had their out sets or money paid for them.
To those of my children that remains single and has not been married may be made equal in out sets or money.
To those to those of my children that is married I do give and bequeath unto my twelve children or their heirs viz. John Brady, Stephen, Elijah, Isaac, Israel, Rhoda, Loretta, Tamer, Joanna, Katharine, Huldah Maria, to be equally divided between them, after my well beloved wife's decease, the principal sum of the above said one equal half of the neat produce or avales of my estate which I ordered my said Executors herein after named to be put at intrest for the said intrest to support my beloved wife during the term of her natural life.
I do order and direct my said executors herein after named to take charge of the legacy herein bequeathed to my daughter, Rhoda Brady, and put the same at intrest and pay her as they may think her need requires.
I do hereby constitute and appoint my trusty friends Thomas Vail and Charles Underhill sole Executors of this my last Will and Testament.
In witness whereof I have hereunto set my hand and seal this tenth day of April in the year of our Lord One Thousand Eight Hundred and Twenty-Five.
Signed, Sealed, Published and declared by the said Testator as and for his last Will and Testament, in our presence who, at his request, in his presence and in the presence of each other have subscribed our names as witnesses thereto.
