Simeon Brady's Will

In the name of God, amen, I,  Simeon Brady,  of Salem in the County of Westchester and State of New York,  being weak of body but of perfect mind and memory,  thanks be given to God for it, and calling to mind the mortality of the body, and knowing that it is appointed for all men once to die,  do make and ordain this my Last Will and Testament, and touching such worldly estate wherewith it has pleased God to bless me with in this life, I give demise and dispose of the same in the following manner and form.

First,  I give and bequeath unto my beloved wife, Mary Brady, the west half of my dwelling house for her dower and said house during her natural life and all the household furniture, one horse and saddle, and four cows.

Also, give and demise unto my son Jesse Brady,  forty five acres of land in New Castle with all buildings and appurtenances in fee simple, his heirs and assign for ever and also seventy-one acres more in Salem, late the property of Isaac Frost, provided he shall pay in one year after my decease Fifty pound New York money to my daughter Phebe Smith.

Also, I give and demise to my son, Ruben Brady in fee simple, his heirs and assign for ever Seventy-one acres of land, part in Salem and the remainder in Bedford, late the property of Peter Harford.

Also, I give and demise to my son, David Brady, his heirs and assign for ever the south west part of my farm adjoining Benjamin Griffins(Kniffins?) land with running a line from the south east corner of his former home lot, southerly to a heap on stones on the line of Increase Millers land and that part of the old farm to be Davids. Also, a piece of land north of the road adjoining his land begining at a heap of stones and stake by the road running northerly to a crocked butnut tree marked, then northerly to Nathaniel Smiths land to a marked walnut tree to be Davids.

Likewise, also I give and demise unto my son, Simeon Brady in manner following:  that part of my farm beginning at the School house on the corner of Increase Millers land, then running northerly by the road to a bridge at the head of the Mill pond then northerly by the fence to the colt pasture then easterly by the fence to the north east corner of said pasture then northerly to a large rock in the line fence of Joseph Brundig's and all the lands west adjoining David Brady.  Also, fourteen acres and three quarters of land lying north of the road, late the property of Josua Weeks, with all the buildings and appurtenances in fee simple, his heirs and assigns for ever with paying one hundred and fifty pounds to Tamer Wolsey and one hundred and fifty pounds to Elizabeth Flager, New York money in one year after my decease.

and I hereby likewise give Give and bequeath to my said son Simeon Brady, together with the lands and the buildings on the said lands above mentioned, all the rest residue and remainder of my personal Estate goods and chattels of what kind and nature so ever to be his and his heirs and assigns forever.

Also, I, give and demise to my son, John Brady, that part of my farm where he now lives beginning near the school house and running in company with his brother, Simeon Brady, so as to take all my land adjoining Edward Brundige to his heirs and assigns for ever, provided he shall pay to my daughter, Mary Brown, fifty pounds New York money in one year after my decease, also pay to my two grandchildren, namely Lowry Brown and Lewis Brown, fifty pounds each New York money when they shall arrive at lawful age.

Also,  I give and demise to my daughter, Phebe Smith,  sixteen acres of land lying south of the road, late the property of Josua Weeks, to be hers during her natural life and to the heirs of her body.  

And I do make, constitute, appoint and ordain my sons Jesse Brady, Ruben Brady and Simeon Brady,  to be my Executors in trust for my said heirs.

In witness whereof, I, the said Simeon Brady, have to my Last Will and Testament, set my hand and seal the tenth day of October in the year of our Lord, One Thousand Eight Hundred and Five, hereby revoking all former wills by me made.

Sighed, published and declared by the said Testator to be his Last Will and Testament, who, at at his request, in his presence (and in the presence) of each other have subscribed our names in writing thereto.

Codicile to Will

I, Simeon Brady, of the Town, Country and State above written, having omited the execution on this above written will do on solid consideration ratify what is above written, and having purchased a piece of land since in North Salem, County of Westchester & State of New York of Abraham Brown, which was formerly the property of James Brown, deceased, containing about one hundred and seven acres of land which I give equally to five of my children, Phebe Smith, Tamer Wolsey, Elizabeth Flager, Mary Brown & David Brady, equally & to their heirs and assign forever.

              In witness where of, I, the said Simeon Brady, have to my Last Will and Testament, set my hand and seal the twentieth day of September in the year of our Lord One Thousand Eight-Hundred and Six.

Edward Brundage Junr, who being duly affirmed on his affirmation--said that he did see Simeon Brady sign and seal the preceeding Written Instrument purporting to be the will of the said Simeon Brady, bearing date the Twentyth day of September in the year of our Lord One Thousand Eight Hundred and Six, and heard him publish and declare the same as and for his Last Will and Testament- that at the time thereof he, the said Simeon Brady, was of sound disposing mind and memory to the best of his knowledge and belief of him, the affirmant and that

                  and the affirmant severally subscribe the said will as witnesses thereto in the testators presence.
