Filing protest petitions: There are two kinds.
Know the difference before you start petitioning.
- Valid Statutory
Protest Petition —
when it meets all
the VSPP requirements, it will result in requiring 3/4ths of
City Council's votes to approve the zoning request. Only
certain types of property owners can sign this type of
petition. And, even then, the petition still has other
requirements before it is deemed "valid."
- Community or
neighborhood petitions
do not have the
same legal impact or specific requirements as a VSPP.
Nevertheless, you should follow the same general guidelines
about listing names, addresses, etc. and having the petition
wording on each signature page. These petitions can be
presented at the public zoning hearing.
