Legal Question: Do ss 3(1)(b) and 3(6)(b) of the Vital Statistics Act, R.S.B.C. 1996, c.479 on their own or in effect, discriminate against biological fathers on the basis of sex, by providing a biological mother the sole discretion to include or exclude information relating to biological fathers when registering the birth of a child, contrary to s 15(1) of the Canadian Charter of Rights and freedoms (April 17,1982)
In a recent landmark decision on June 6, 2003, my friend Darrell Trociuk, in the case of Trociuk v British Columbia, 2003 SCC 34. file # 28726 had this very question answered
by the Supreme Court of Canada in a 9-0 decision. Justice declared that c. 479 ss 3(1)(b) and 3(6)(b) of the Vital Statistics Act infringe upon a fathers equality rights based on gender  discrimination and have given the Provincial Legislators 1 year to amend the Vital Statistics Act or it will be of no force or effect.
Interesting to note, as my own case file affirms, the Supreme Court of BC has ruled
in favor of infringing upon a father's Equality Rights. Confirming that fathers and
justice do not belong in the same sentence.
