Here's some questions and answers I've picked up surfing the net. I think you'll find it interesting how some of the same claims come from both sides!

QUESTION:

States mandate auto insurance. Can you give me any information as to why states do not specify what information auto insurers can require for citizens to buy mandatory auto insurance?

REPLY:

Probably because insurance companies pay for the legislation they want, or the legislation they want to avoid. It's called campaign contributions, but it should be known as legislative bribery.

What is No-Fault Insurance?
REPLY:
No-fault insurance is a system adopted in some states that essentially bypasses the conventional legal procedure which finds fault in an accident. (This is the procedure by which you hire a lawyer, file suit and possibly go to court to prove the accident was the other guy's fault) No-fault simply does away with the concept of one party or the other being at fault--no lawyers, no court, no judge, no jury, no lengthy lawsuits against the other party. This is considered beneficial to taxpayers, because it eliminates costly legal proceedings that the state must manage, and to insurance policyholders, because it helps keep rates down.
If you are insured in a no-fault state and have an accident, you don't go after the other driver. You contact your own insurer and file a claim. Your own insurance policy guarantees you immediate compensation for damages, medical expenses, lost wages, etc.

MY OPINION


Does what you've just read sound familiar? Anyone that has read much of my pages will notice the above, sounds like what I've been saying. But from what I've seen (read) lately the familiarity stops there. I've been checking search engines lately and have run into a lot of negative opinions on No Fault. The things most of the people are complaining about, doesn't sound like the system I'm suggesting. I've always tried to avoid calling my idea "NO-Fault". Its based in the No-Fault theory, but in my opinion it shouldn't go much past what has been described above.
One thing not mentioned above is the "Special Circumstances". There's always going to be examples of exceptions. Like;
1) Being involved in an accident with a commercial vehicle (Fault could matter in this case)
2) In the case of disability you should be able to file suit against your own insurance carrier.
What it boils down to, there should be exceptions and special circumstance, provided for in the governing law.

I've had just about every reaction you can imagine since I've started these web pages against "Mandatory Auto Insurance". But the one that keeps coming up over and over is "Why should my insurance pay if the accident is your fault?" It never ceases to amaze me how people can be used and abused and in general "Totally screwed around" by their insurance carriers, and yet - - they are STILL protective of their tormentors! Scared to death to turn in a claim because of the retribution that will be visited upon them for doing it,- - -and yet, will argue with me all day about "Why should their poor insurance company have to pay?" :-(
How can an Insurance Company claim to care about their clients, when in reality, they're poised and ready to raise your rates (and your risk rating) if you make one false move? If you have time, check out my Feedback Page and read the message from the lady in New Jersey who said if you get hit from behind, while sitting at a stop sign/light, you'll be assigned a percentage of fault!! ( Hey- - -I dont know? Maybe you shouldn't have been there?)
For those of us that have FULL coverage (gettin the full screwin), if you'll check out your policy you might (?) come across something that's called "Medical Payments Coverage" This is a "Rider" ("add on" to your policy) that provides coverage for medical and funeral expenses for you and your passengers "Regardless of Fault"!! Proof positive that they DO know how to sell "N0-Fault" insurance!!! - - They just dont want to do it without charging extra.
If you looked that up, keep looking and see if you can find, "Un-insured / Under insured Motorist Coverage". Most states require the Insurance Companies to offer this coverage.- - - Recommended coverage \\$100,000 - $300,000- -. This "rider" is to cover you in case of an accident with an "Uninsured/Under Insured" driver- - -. I mention these two items, to stress my contintion that the Auto Insurance Industry can and will sell insurance to you with no restrictions concerning "Fault" (without the world coming to an end!). ---They just dont like it! Mainly because they might only make 50 billion instead of 100 billion!!
Anyone reading this (that has been in a state purposing "NO-Fault Insurance"), might remember some of the gloom and doom warnings from the Insurance Industry.- - - All the time they were predicting gloom & doom, they not only knew their warnings weren't true, but they've had "NO-FAULT" available all along (evidenced by the fact they're already selling "No Fault" insurance as "riders", and available "add ons")!!
- - - - - - - - - That brings me right smack dab back where I started from, - - - - - - - - - - - - - - - - - "WHY" (?) are people so quick to worry about their poor little Insurance Companies???
