COs Eyal Brami and Misha Hadar Imprisoned. Refuse to Cooperate with Military Prison Authorities

Dear Friends,

After a month's break, we resume our prisoner updates.

Let us first begin with the good news: CO Yahel Avigur has been finally discharged from the military (officially - on medical grounds), and is no longer in danger of further imprisonment. Thanks to all who took action on his case.

The other four objectors, on whose cases we have reported in the past, are in prison at the moment. More details follow below.

COs Eyal Brami and Misha Hadar Imprisoned. Refuse to Cooperate with Military Prison Authorities

Objectors Misha Hadar and Eyal Brami have both made a decision to refuse from now on to wear a military uniform and follow orders while in prison. Misha Hadar has formulated this decision in the following letter:

June 2005

It is now two months since my first refusal to serve in the Israeli army and since I made my request to be heard by a "conscience committee" – a right which I have so far been denied. After several terms in jail I have come to the conclusion that sooner or later, any dialogue with the military follows the logic of the military - a way of thinking which is fundamentally lacking in conscience, which bases itself in brute force, and which, since 1967 leads to the consistent abuse of the Palestinian people and their rights.
In my case, the army has rejected outright and without any explanation my repeated appeals to be allowed to appear before the conscience committee, or to voice my arguments in an alternative way.

As a result, I feel that any attempt on my part to speak has become wholly superfluous. In fact, it only creates strange types of co-operation with what is lacking in conscience. I will, therefore, from now on, no longer have any communication with representatives of the military as such. At the same time I will be very willing to respond to anyone who, as an individual - even if he or she be uniformed - addresses me as an individual person with rights. This situation would, of course, change should I be allowed to appear before the conscience committee.

Misha Hadar

Misha's fourth prison term, of 28 days, began on 6 June. At first he was sent by the prison authorities to the Isolation Ward of the prison, but once this fact was brought to the attention of the Commander of the Prison (by Adv. Smadar Ben-Nathan, who visited Misha in prison on New Profile's behalf), this decision was reversed, and Misha is now held in the Reserves Company of the prison. He is due to be released from prison on 1 July, and is quite likely to be imprisoned again afterwards.

Eyal Brami followed the same course of action as Misha Hadar, when he was imprisoned for the fourth time for 21 days on 20 June. As far as we know he is right now held in the Isolation Ward of Military Prison no. 4. Eyal is due to be released from prison on 8 July, and is likely to be imprisoned again afterwards.

Fourth Prison Term for CO Wissam Qablan

CO Wissam Qablan has been imprisoned twice since our last update - once for 7 days, and again, on 5 June, to 21 days in prison. He is held in Military Prison No. 6. He is due to be released this Friday, 24 June, and it is possible that he will be imprisoned again afterwards.

One correction about Wissam's personal details that we owe you - Wissam is 20 years old (not 18, as previously published). He refused to be enlisted already back in 2003, and only this year has turned himself in to the military authorities to face imprisonment.

Fourth Prison Term for CO Alex Kohn

CO Alex Kohn has been imprisoned for the fourth time on 20 June, this time for 21 days. He is held in Military Prison no. 4, and is due to be released from prison on 8 July. He is likely to be imprisoned again after his release.

First of all, please circulate this message and the information contained in it as widely as possible, not only through e-mail, but also on websites, conventional media, by word of mouth, etc.

It would be especially useful to send your appeals to the Commander of the Induction Base in Tel-HaShomer. It is this officer that ultimately decides whether an objector is to be exempted from military service or sent to another round in prison:

Here is a sample letter, which you can use, or better adapt, in sending appeals to authorities on the prisoners' behalf:

Dear Sir/Madam,

It has come to my attention that [name & military ID], a conscientious objector, has been imprisoned for his refusal to perform military service for the [n-th] time in a row, and is held in Military Prison No. [4/6].

The imprisonment of conscientious objectors such as [name] is a violation of international law, of basic human rights and of plain morals. The repeated imprisonment of conscientious objectors is an especially grave offence, as it means sentencing a person more than once for the same offence, and has been judged by the UN Working Group on Arbitrary Detention to constitute a clear case arbitrary detention.

I therefore call for the immediate and unconditional release from prison of [name], without threat of further imprisonment in the future.

3. Letters to media in Israel and in other countries

Writing op-ed pieces and letters to editors of media in Israel and other countries could also be quite useful in indirectly but powerfully pressuring the military authorities to let go of the objectors and in bringing their plight and their cause to public attention.

נתחיל מהחדשות הטובות. הסרבן יהל אביגור קיבל פטור משירות צבאי (רשמית - מטעמי בריאות), ואינו נמצא מעתה בסכנה של כליאה נוספת. תודה רבה לכל מי שפעלו בעניינו.

ארבעת הסרבנים האחרים שעל מאסרם דיווחנו בעבר נמצאים כרגע בכלא הצבאי. להלן הפרטים המלאים.

הסרבנים מישה הדר ואיל ברמי נכלאו שוב, ומסרבים לשתף פעולה עם שלטונות הכלא

הסרבנים מישה הדר ואייל ברמי החליטו שניהם לסרב מעתה ללבוש מדי צבא ולציית לפקודות צבאיות גם בכלא הצבאי. מישה הדר ניסח החלטה זו במכתב הבא, שעותקים ממנו חולקו על ידו לכל גורם צבאי רלוונטי:

יוני 2005

לאחר חודשיים שבהם אני מסרב להתגייס, תוך בקשה לקבלת וועדת מצפון, זכות שנשללת ממני, תוך כניסה ויציאה חוזרים מהכלא, הגעתי למסקנה שכל דו-שיח עם הצבא מקבל במוקדם או במאוחר את ההיגיון הצבאי, היגיון שהוא חסר מצפון מעיקרו, היגיון כוחני, היגיון שאפשר מאז 67 התעמרות מתמדת בפלסטינים ובזכויותיהם. במקרה שלי, פניותיי החוזרות להישמע בפני וועדת מצפון, או להשמיע את טיעוני בדרך אחרת, נדחו על הסף וללא כל הנמקה מצד הצבא.

עקב כך אני מרגיש שכל דיבור מצדי נעשה מיותר לחלוטין, ורק יוצר דרכים משונות של שיתוף פעולה עם חוסר המצפון. לכן, מכאן ואילך, לא יהיה לי כל דיבור עם נציגי הצבא בתור שכאלה, בו בזמן שכל פנייה אלי בתור פרט בעל זכויות ע"י פרט אוטונומי יתקבלו בברכה, אף אם הוא לובש מדים. כמובן שהופעתי בפני וועדת מצפון תשנה מצב עניינים זה.

מישה הדר

תקופת המחבוש הרביעית של מישה, בת 28 ימים, התחילה ב-6/6. תחילה הוא נשלח לאגף הבידוד בכלא 4, אך כאשר עובדה זו הובאה לידיעתו של מפקד הכלא (על ידי עו"ד סמדר בן-נתן, בביקור שערכה בכלא מטעם פרופיל חדש), החלטה זו שונתה, ומישה הועבר לפלוגת המילואים בכלא. מישה צפוי להשתחרר מן הכלא ב-1/7, וסביר למדי שייכלא שוב לאחר מכן.

אייל ברמי בחר באותו קו פעולה כמו מישה הדר, כאשר נכלא בפעם הרביעית, ל-21 יום, ב-20/6. למיטב ידיעתנו הוא מוחזק כרגע באגף הבידוד של כלא 4 אייל צפוי להשתחרר מהכלא ב-8/7, וסביר כי ייכלא שוב לאחר שחרורו.

תקופת מחבוש רביעית לסרבן ויסאם קבלאן

הסרבן ויסאם קבלאן נכלא פעמיים מאז העדכון האחרון שלנו בעניינו - פעם אחת ל-7 ימים, ופעם שניה, ב-5/6, ל-21 ימי מחבוש. הוא מוחזק בכלא 6 וצפוי להשתחרר מן הכלא ביום ו' הקרוב, 24/6. הוא עשוי להיכלא שוב לאחר מכן.

באותה הזדמנות עלינו לתקן פרט שגוי שפרסמנו בעדכונים הקודמים שלנו לגבי ויסאם. ויסאם הוא בן 20, ולא בן 18. הוא סירב להתגייס כבר בסוף שנת 2003, ולא התייצב בבקו"מ ביום הגיוס שנקבע לו. רק השנה החליט ויסאם להסגיר את עצמו לשלטונות הצבא ולהיכלא בגין סירובו.

נודע לי כי [שם ומספר אישי], סרבן מצפון, מוחזק בכלא [4/6] בגין סירובו המצפוני לשרת בצבא. זוהי לו כבר תקופת המאסר ה[שניה\שלישית\...] אותה הוא מרצה על אותה ה'עבירה'.

כליאתם של סרבני מצפון דוגמת [שם] מהווה הפרה ברורה של החוק הבינלאומי ושל זכויות אדם בסיסיות, ומנוגדת לכל מוסר אנושי. כליאה חוזרת של סרבני מצפון מהווה עבירה חמורה במיוחד, כיוון שמדובר בשפיטה חוזרת של אדם על מעשה שכבר הורשע בגינו. הדבר מנוגד לעקרונות המשפט ושלטון החוק, וכבר נקבע בפורומים הבינלאומיים המוסמכים לכך שכליאה חוזרת כזו אינה אלא צורה של מעצר שרירותי.

על-כן אני פונה אליך בדרישה לשחרר את [שם] לאלתר מכלאו, ולהימנע מכליאתו שוב בעתיד.
