PRELIMINARY HEARING PURPOSE To finalize the people or groups to be represented and the legal/scientific issues that will be argued at the Contested Case Hearing against: Montgomery Landfill Solutions MSW #2324 Permit Application Type IV Landfill 3761 North Walker Road Security, Texas WHAT YOU NEED TO KNOW - Please plan to attend. A good turnout will show MLS and TCEQ that we are determined to stop this landfill and that we are committed to the fight and the Contested Case Hearing. - If you own property within a mile of the proposed facility then TCEQ will probably agree that you are an affected person and that if you wish, you can be included in the Contested Case Hearing. - CAML has standing at the Contested Case Hearing. Blackburn and Carter attorneys represent CAML. Anyone who is a member of CAML will be represented at the hearing. - You can also request to be an affected person with independent standing at the hearing. TCEQ will consider anyone who lives within a mile of the proposed landfill. Bring a utility bill or some piece of evidence to show your address. MEETING PURPOSE To inform the community about the TCEQ Preliminary Hearing for: Montgomery Landfill Solutions MSW #2324 Permit Application Type IV Landfill 3761 North Walker Road Security, Texas Preliminary Meeting LANDFILL UPDATE -TCEQ has granted CAML and the surrounding community a Contested Case Hearing (CCH) that will allow us to formally present our legal, health and safety and scientific case against the landfill -It is very important that citizens are informed about this hazard and their rights at the CCH. -CAML has been fighting for 6 years to help the community finally Stop the Landfill -CAML leadership, attorneys, and local officials will provide an update and answer questions about the TCEQ Contested Case Hearing and the TCEQ Preliminary Hearing on Sept 24. -TCEQ will hold a Preliminary Hearing at 10:00 AM, September 24, at the Lone Star Convention Center to determine the participants in the Contested Case Hearing (CCH) and all of the issues that will be heard at the CCH. -The proposed landfill will be located 2.0 miles east of Cut & Shoot on the west side of North Walker Road in Security. -It will include 473 acres and will accept 600+ semi-truckloads of construction and demolition waste per day. That is 1,200+ truck trips per day in our community. -The landfill will be 250 ft above the ground and 70 ft below the ground. -It has the potential to cause irreversible groundwater/surface water contamination and to cause dangerous traffic conditions on SH 105 and local roadways. CAML LANDFILL UPDATE July 10, 2009, Please click on the Update tab to read the July 10, 2009 Conroe Courier Article and to see more details on the permit Update •The permit is definitely NOT a “Done Deal” – the battle goes on!!! •Thanks to everyone who attended the TCEQ agenda meeting July 8, 2009, in Austin! •About 50 folks from Security and Cut and Shoot went to Austin to attend the TCEQ meeting to formally request a Contested Case Hearing. •Many thanks to County Commissioner Rinehart, County Commissioner Doyle and County Judge Sadler for donating the charter bus for the trip to Austin. •Many thanks to State Senator Nichols for attending the meeting and speaking in our behalf! •Many thanks to State Representative Creighton for sending a representative. What’s Next •TCEQ will hold a Preliminary Hearing to determine who the affected persons are and to set a date for the Contested Case Hearing with the TCEQ Commissioners •The Contested Case Hearing (CCH) with TCEQ will allow the community to make it’s case against the permit and to raise issues such as land-use, traffic, groundwater and surface water contamination and many more as noted in CAML’s formal comments. •CAML will hold a community-wide public meeting to educate the community as soon as the date for the Preliminary Hearing date is set. •The Preliminary Hearing will be held in the next 2-3 months. The Proposed Landfill site - MLS Permit #2324 •The site is located 1.4 miles north of Midway/Security on •The permit allows 600 waste trucks per day to the site – about one truck per minute. •MLS cannot open for business until the Hearing is resolved. •CAML winning the Contested Case Hearing can finally stop the landfill for good!
