LEGAL CUSTODIAN'S OF NOONDAY CEMETERY
Preserving a cemetery is an expensive task and CAN NOT be preformed while vandalism is taking place. It is very important for the history of the African American community and Cobb County history to have this location saved and for vandalism to stop.
HISTORY OF NOONDAY
Why this location has gotten a reputation for being haunted?? HAVE NO IDEA!!! If you do a search for "Devil's Turnaround" on the internet, you not only come to this page, but hundreds of others. All mentioning that the cemeteries are haunted by cold spots, unexplained scratches, screaming cats, animal sacrifices, man hung on the property, church burned on the property and millions of other comments about the location. In reality,, all are false.
Began in the mid 1800's, Noonday Baptist Cemetery belongs to Cobb Counties oldest active African American church. Though the cemetery was moved from it's original location, it's burials consists of Maynard Jackson Sr, father of Atlanta's first black mayor and founder of the Georgia Voters League and two well loved servants who were cousins, paid and free black servants during the late 1800's.
History Lesson Folks
There has never been anyone hung on the property!!!!!! Rumor has it that a young man was hung from one of the old trees.. That never has happened on the property or the properties surrounding the location.
There has never been a church burned with all it's occupants inside, on the property!!!!!! Actually, there has never been a church on or surrounding the properties.
There has never been an animal sacrificed and buried on the property... There was a dog that died on the property but of natural death. The animal was not gutted and had it's throat slashed.
The location has not been there since before the Civil War because this is not the original location of the burial.. There was not even a grave period there during the Civil War, or even 100 years after the war.
NO ONE has actually been attacked by a "ENTITY" on the location while wearing a crucifix or holding a bible. This has been tested!!!!!!!! There are briars EVERYWHERE!!!!!!!!!!!!!!!!!!
Stones don't photograph well at night because..... IT'S DARK!!!!!!!!!!!
Objects DO NOT thrown at people... THOSE ARE LEAVES, PINE CONES and other objects from the trees!!!!!!!!
That is not laughter from spirits of children,,, THAT'S THE NEIGHBORHOOD BEHIND THE LOCATION!!!!!!! We've seen those kids up at 2 am on weekends.
NOT A ONE of those buried there has tried to climb out of the grave!!!!! SOMEONE DID TRY TO DIG SOMEONE UP and was arrested for it!!!!!
PENTAGRAMS ARE NOT SATANIC!!!!!!!! Satanism is a new religion no more than 200 years old!!!!! The pentagram is thousands of years old!!!!!!!!!!
This location, knows as Devil's Turnaround, has gained a horrific reputation over the years as a location possessed by an "evil entity" that scratches legs, where a church was burned with occupants inside, the site of a hanging and sacrificial murders from the 1800's into this day and age. All these myths are just myths, urban legends.
We have documented vandalism that is disgraceful to this day and age. From carving on stones to hitting the cemetery sign with a car. Leaving drinking cups, beer cans/ bottles, condoms and needles through out the location. THIS IS VANDALISM, this is not acceptable in our society.
The two locations are strictly OFF LIMITS for all investigations, researches or "ghost hunts". All trespassers will be arrested and prosecuted to the fullest the law will allow. There will be no exceptions PERIOD.
We have included some of the damages on this page for those who need proof. We do not maintain a website due to some of our locations getting vandalized from the information given for genealogical research that turned into "ghost hunts". GA Code Title 16, Section 16-7-21 states:
A) A person commits the offense of criminal trespass when
he or she intentionally damages any property of another without consent of
the other person and the damage thereto is $500.00 or less or knowingly and
maliciously interferes with the possession or use of the property of another
person without consent of that person.
B) A person commits the offense of criminal trespass when he or she
knowingly and without authority:
Enters upon the land or premises of another
person for an unlawful purpose.
Enters upon the land or premises of another person
after receiving, prior to such entry, notice from the owner, rightful
occupant, or upon proper identification without expressed permission from
owner, authorized representative of the owner or rightful occupant.
Remains upon the land or premises of another person after receiving notice from the owner, rightful occupant or upon proper identification and notification, or is notified by owner, authorized representative of the owner or rightful occupant to depart.
For the purposes of subsection (b) of this Code section, permission to enter or invitation to enter given by a minor who is or is not present on or in the property of the minor’s parent or guardian is not sufficient to allow lawful entry of another person upon the land or premises.
A person who commits the offense of criminal trespass shall be guilty of a misdemeanor.
A person commits the offense of criminal trespass when he or she defaces, mutilates, or defiles any grave marker, monument or memorial to one or more persons.
Punishment: Misdemeanor, up to 12 months with fines and damage reimbursement.
GA Code Title 16, Sections 16-11-36 states:
A) A person commits the offense of loitering or prowling when he is in a place at a time or in a manner not usual for law-abiding individuals under circumstances that warrant a justifiable and reasonable alarm or immediate concern for the safety of persons or property in the vicinity.
GA Code Title 37, Section 37-3-8 states:
Any person who loiters about or trespasses on the property of any state owned or state operated psychiatric hospital or drives or rides over the grounds or roads of such hospital property with horses, automobiles, bicycles, motorcycles or other vehicles, except in accordance with such rules and regulations as may be posted under the authority of the board, commits the offense of criminal trespass.
GA Code Title 51, Section 51-9-4 states:
The person having title, or legal entity acting on their behalf, to lands may bring an action for a trespass thereon.
GA Code Title 51, Section 51-10-3 states:
Any unlawful abuse of or damage done to the personal property of another constitutes a trespass for which damages may be recovered.

GEORGIA LAWS REGARDING TRESPASSING
If you don't own the property, then you are trespassing, even if it's not posted.
GA Code Title 16, Section 16-7-22 States:
A person convicted of the offense of criminal damage to property in the first degree shall be punished by imprisonment for not less than one nor more than ten years.
Punishment: Felony, 1 to 10 years in prison.
GA Code Title 31, Section 31-21-44 states:
A) It is unlawful for any person wantonly or maliciously
to:
1) Remove the dead body of a human being from any grove or
other place of interment or from any vault, tomb, or sepulcher; or
2) Otherwise disturb the contents of any grave or other place
of interment or any vault, tomb, or sepulcher.
GA Code Title 36, Section 36-72-1 states:
A) The care accorded the remains of deceased persons reflects respect and regard for human dignity as well as
cultural, spiritual, and religious values. The General Assembly declares that human remains and burial objects are not property to be owned by the person or entity which owns the land or water where the human remains and burial objects are interred or discovered, but human remains and burial object are a part of the finite, irreplaceable, and nonrenewable cultural heritage of the people of Georgia which should be protected.GA Code Title 36, Section 36-72-16 states:
Any person who knowingly fails to comply with provision of the law shall be guilty of a misdemeanor of a high and aggravated nature and, upon conviction, shall pay a fine of not more than $5,000.00 for each grave disturbed.

Those buried in cemeteries and graveyards are the true finding father's of our county. They lived, worked and died as real American's and they have made our country what we have now. Though some have markers of simple fieldstones or no stones and some have elaborate headstones, these individual's, families and those related to them deserve to have the same respect given to a living person.
We understand the importance of paranormal research and we understand that, like cemeteries for us, this research is a passion for others. We are sorry that legitimate investigators/ researchers are also banned from further investigations until further notice. Those who have been caught on the property after the posting of the signs are not permitted onto the property in the future.

Some of those reading this may take this a threat, but Southern Cemeteries is serious about preserving and protecting cemeteries and for those who come into the bounds to damage historical artifacts or perform acts that are illegal or disrespectful are subject to this kind of action.
On a personal note from the members and volunteers of Southern Cemeteries. Those who perform these acts are extremely immoral and need to step back and look at themselves and how they would feel if someone had done this to their mother, father, sister, brother, child, etc. The violation of these historical markers is what more and more individuals, groups and government are protecting. These individuals may not be still living, but there are those who are living still looking out for their best interests.
