What Happened on Friday 19th July at the City Council Hearing

On Friday July 19th 2002 Auckland City Council’s Regulatory and Fixtures Sub-committee met to consider applications for Resource Consent. Those on the subcommittee were: Councillor BiII Christian, Councillor Graeme Mulholland, and Councillor Juliet Yates (chair).
Two applications were heard concerning the site at 17 Kelly Street:

  1. Applicant — ESR Ltd, for consent to excavate 5,800m3 of soil and basalt (1 ,700m3 for remedial purposes and a further 4,100m3 the facilitate the developer’s plans for basement garaging).
  2. Applicant - Glenstone Ltd (Neil Wanden) for consent to build 22 three-storied apartments on the site.

Two letters were presented;

  • one from a lawyer urging that all three resource consent applications (i.e. the two under consideration and the previous one on which many of us made submissions but which is now on hold at the request of the developer) should be heard together,
  • and another from Keith Locke, MP suggesting that the hearing of these applications should be postponed as the developer’s purchase is currently under investigation by the Auditor-General.

Both letters were dismissed!

Assessments and recommendations on both applications were presented by Auckland City planner Mark Leotta.

ALL EFFECTS, ENVIRONMENTAL AND SOCIAL, IN ALL AREAS (HERITAGE, FLORA AND FAUNA, TRAFFIC CONGESTION, ETC., AND ON LOCAL RESIDENTS IN TERMS OF NOISE, DUST, LOSS OF LIGHT, ETC. WERE STATED TO BE EITHER ‘NIL’ OR ‘DE MINIMIS’ (INSIGNIFICANT).

In both cases Mr. Leotta’s report concluded:

  • “Section 94 Recommendation...
  • “That pursuant to Section 94 of the Resource Management Act 1991, this application be processed without notice because:
    • The adverse effect on the environment of the activity for which consent is sought will be de minim is.
    • There are no persons considered to be adversely affected by the granting of this resource consent; and
    • There are no special circumstances to warrant notification.”
Councillor Glenda Fryer was present, and was permitted to ask a few questions — all of which were rebuffed. We thank her for trying!

BOTH APPLICATIONS WERE GRANTED RESOURCE CONSENT.

A good number of MENRA members and supporters attended the hearing and left angry and disillusioned by the process.

SO — the bulldozers, diggers, drills, excavators, trucks noise, dust and high walls are cleared to move in. The trees, tuis, peace and life-as-we-live-it here are about to move out, and Eden loses its last hope for more greenspace.
