His Will:
Amherst Co., VA Will Book 24 Page 47: I Joseph A. Higginbotham of the County of Amherst and State of Virginia, Witnesseth: That for and in consideration of the uncertainty of this mortal life and the certainty of death, do make this my last will and testament.
First: I will that all my just debts be paid.
Second: I will and bequeath to my beloved wife Hester Higginbotham the balance of my estate both real and personal property to have and control for her own benefit until her death, and then to be divided equally between my children or their heirs according to law of descendents.
Third: I hereby appoint my son Joe Lee Higginbotham, Executor of my last will and testament and pray that the Court not to require security of him.
Given under my signature and seal this the 10th day of Oct. 1902.

Virginia In the Clerks Office of the Circuit Court of Amherst County April 17, 1904 a paper purporting to be the last will and testament of Joseph A. Higginbotham, bearing date on the 10th day of October, 1902, was this day produced, before me in said office and proved by the oaths of Marcellus Campbell and R.L. Tucker, two subscribing witnesses thereto, was admitted to record.
