Michael B.
I'm a grandmother who is still trying to find the answer to getting my grandson returned to my daughter - from the other grandparents, who used CPS to take him far away - to another state so the biological mother could have no contact with him.
I am getting ready to go back to school. I was inspired by the way the legal system don't give a rats tail about young, neive, mostly uneducated, indigent parents when CPS simple yanks children away and places the children with people who make more money, have beautiful expensive homes, and cars - and the biological parent(s) are kept at bay because they have no resources.
Hmmm, I wonder as I sit here typing this if I really want to go to all the trouble of telling yet another person this story, most people really do not care. Almost goes without saying...truely & utterly. To begin with I had emailed everybody, includding the state reps, the Mayor of Jacksonville, the Governor, the President of the United States... and whoever else I thought would put justice into the situation my family was in. "Right". I at first was shocked that nobody cared! Now, the shock is gone - replaced with a feeling of being jaded. The replys I recieved from the above mentioned ranged from; no reply, to "that's why we have a court system". The latest was when I ask Corrine Brown to help intervene, I got a reply "Corrine Brown is looking into it". That was months ago. Guess she is still looking into it? The story: Feburary 11th, 2000 my first grandchild was born, I noticed as the nurse was cleaning him up that under his eye was a bump, it looked as if someone had socked him. To make this part shorter I will skip alot, turned out it was a rabdomyo-sarcoma cancereous tumor. The doctor at birth - sent him home, said it was a blood tumor and it may get bigger, but eventually it would go away. The paternal grandparents turned my daughter and their son in to CPS (Child Protection Services), my daughter and her then husband were investigated and the case was closed because they were not medically neglecting their son. Next thing ya know, the son-in-law talked my daughter into moving in with his parents, saying I was probably the most evil person on earth. Live in my house, eat off my plates, let me provide your every convience and call me evil. Yeah, I was mad. I didn't talk to my daughter for a couple of days, she told me that after the father-in-law help unloaded their belongings at his home, he told them that they were not welcome to stay, not even the night! Son-in-law refused to bring my daughter and baby back to my home. Convinced my daughter to let their son stay with his parents, until their apartment was ready, that would take maybe two weeks at best and they were homeless. Two days later my daughter and her worthless came over minus the baby, said they weren't allowed to bring the baby to my house or his dad would call CPS and report that they were homeless and they would lose their child. I had provided my grandsons every need, was there when he went through his surgeries and chemo, these people Never showed up and now they weren't going to allow me to see my only grandbaby who was terminal, and they were threatening my daughter! Well they called CPS anyway, I should have seen that one coming a mile away. CPS placed my grandson with these people. They told CPS that he (Michael)didn't have any other family (Never mind they Knew I lived only 2 blocks away). That he (Michael)was abandoned at their house, and that the parents (My daughter & worthless)were using the social security the baby was on to buy drugs, that the parents didn't have a job (Never mind that they were still qualifing for SSI, and who can afford drugs when you don't have an income?). They forgot to tell the caseworker that my daughter had helped to clean up their house (it was a discusting wreck); that my daughter and her worthless had painted a room for their baby under the guise that his parents were now miraculasly being very helpful; that they had done a ceromony where they had dumped all their drug parafanila in the st. johns river; that they had only a year and half earlier absconded their eldest from foster care in North Carolina, then promply kicked him out when they couldn't control him - he had been in foster for 9 years; That the step-paternal grandmother often spent time at Charter by the Sea; MOST important of all they forgot to tell CPS during their conversation that the reason their children had been taken from them was because paternal grandfather had molested his youngest son! The attorney that was appointed to the case...I said the case, not my grandson or daughter - "the case", was hardly ever available because ya know they are loaded down with cases and don't have much time to devote to any "one case". My daughter was completing her case plan, point by point, and the caseworkers were happy with the rate of progress she was making because they knew she wanted her son back. She also knew what her father in law had done, and didn't want her child in that invironment. Child support was to be paid directly to the paternal grandparents, even though CPS knew there was a conflict of interest. Conflict of interest? Well, the mother was always wanting to see her baby, and gee whiz it was really getting bothersome, heck it was madding when the baby called "her" -mom... The caseworker told them my daughter was working very hard on her caseplan, ohhh nooooo time to move away now. They told the caseworker they were planning on moving to Montana, and the move was in full swing. Montana? what's there? Oh well ya see paternal grandfather found out he had a long lost sister he just just just found out he had and well he had to move right away! Wrong! the caseworker took imediate action by sending a petion to the court to remove my grandson from their care. This was THE ONLY thing this caseworker had done to show that she was trying to reunite mother and child. When it came down to a day before court, the paternal grandparents changed their minds and decided to stay in Florida. Case dismissed...Whew!, nice save. A few months went by and "oh we decided to move to "Lake City, FL (paternal grandfathers father is elderly and doesn't have much time left) is that o.k? (Never mind he had repeatedly told the caseworker he had to go take care of his elderly parents in "OLD TOWNE"... they had used this last statement to take extended trips, you can be sure it was only to get distance between mother and child) Sure lets just close this case first even though we are supposed to give the parents a year, and see ya! The casewoker kept telling us that a court date was coming up, but she didn't know the exact day, well the night before court 11pm... the caseworker showed up at my daughters apartment and gave her the notice to appear. My daughter called her attorney and surprize surprize, he knew nothing about the court date, but he simply could not make it because well he had other cases, but if he had time he'd duck his head in and ask the Judge to move the hearing to another date where he'd make sure they didn't move. Well of course he didn't have the time to do that. The Judge said they were to bring the baby to Jacksonville, FL once a month from "Lake City" for one hour of unsupervised visits and until they moved my daughter was given unsupervised visits, as much as she wanted the Judge said and the paternal grandfather shook his head up and down vigerously. They were to give the caseworker their "Lake City" address and phone number which she in turn was to give to my daughter. While they were moving they told my daughter if she was very good, they'd let her say "goodbye". That didn't happen. They forwarded their phone to Tampa where they had an older daughter, and stayed there. When she did get ahold of them, they told her the court papers didn't acuratly state what the Judge had ordered, that she was not given unsupervised visits. About six weeks went by and they simply disapeared...NOBODY knew where they went. My daughter called the caseworker and asked for the information she was to be provided and the caseworker told her that was confidencial information. She found out from her exhusband they moved to Montana. I hired an attorney for my daughter almost a year later. He found them in Broadus, Montana. They violated court orders, he went to court, the Judge said yes serve them with contempt of court, bring them back and let them explain why they are in contempt of court. Before that next court date it was interesting to note that those people who had disapeared remembered my daughters address and invited her to their home in Montana. At that next court date, that same Judge after reading the paternal grandfathers statement that "they were strained financially because they had just bought a house, that they simply could not make it, and it is interesting that the childs mother is behind in child support payments. Lastly the mother was invited to visit with the child but refused. (She was eight months pregnant and couldn't jepordize her unborn child on a bus ride). The Judge said basically "so what." Now a year later, we have yet to hear again from these people, guess they lost my daughters address again. They stopped putting the babys photo on the net after my ex son in law told my daughter where to find them on the net. Currently we are awaiting the appeal process. I know nobody cares, afterall...it's the bad parent who gets their child taken away right? I find that it's the young, poor, and nieve' parents that nobody (AS IN THE GENERAL PUBLIC AND ALL OF GOVERNMENT)cares about who face simular situations. I personally have never lost custody of my children, and only know what it is like to have lost a grandchild. If we could start this all over again what would I do different? Well for starters, I wouldn't take in any child off the street no matter what their story is. I had taken in their son who was homeless...; I used to help anybody who came to me homeless. Not anymore. I also would also treat CPS like my new best friends. Is my daughter a victim? YES she is, she is a victim of CPS, and she is also a victim of the paternal grandparents who went to any length to take her child away for the selfish reason of wanting a baby and not being able to have a biological one of their own.

May 13th, 2003 -UPDATE-

Never got to the appeals process. I paid thousands of dollars to an attorney , and nothing changed, nothing. I never got to say goodbye... After the newly hired attorney located the paternals and provided a PO box to My daughter - Sis contacted them, and they mailed their phone number in a strange letter to her, which said something like - Why haven't you written or called Michael? We've been waiting on you... blah blah blah as if she even knew where the heck they were, I think it was said to cover their collective butts!

she called and was allowed to talk to Michael!!! He calls Them mom and dad, they said it was all Michaels idea to do so... right - how does a 3 year old just start calling someone mom and dad? Anyway...

They don't call him Michael , they call him Eli...

My daughter has remarried - I now have a grand-daughter, and as I already knew... My daughter is a terific mother, she just wasn't allowed to show how great she was for Michael.

If you read all of this, thankyou for just reading it, I know already there is NOTHING you can do and I do not expect anything to come of it. Another person knows.

Update 10/31/2003---->

Living in Limbo, the paternal grandparents continue to be in contempt of court. Right after my last update - the snakes disconnected their phone, no surprize there huh? Daughters last phone call to her son - he said to leave him alone, don't call anymore and that he is happy. Yeah, all that from a three year old.
