Amy, The person was charged with homicide by motor vehicle while intoxicated and that is what she pled guilty to. Sentencing will occur in late February. How Brandy obtained alcohol is a matter still under investigation and will be prosecuted if witnesses come forward and say where it came from. |

The reason I'm writing you is to ask just what the drunk driver of the car that killed my cousin and best friend Brandy Talbot was charged with? I understand Brandy was not wearing a seat belt, and was also intoxicated . I also was told that the driver is under age. That means that someone bought the alcohol for her. Were they charged ? Some one gave Brandy alcohol. Were they charged? Was Brandy intoxicated beyond consciousness that she was carried to the vehicle against her will ? Again i ask why wasn't anyone charged with this ? I knew Brandy all my life, I never knew of her not putting on her set belt, AND MOST OF ALL I NEVER NEVER NEVER KNEW OF HER DRINKING EVER !!!!! Brandy has always set a good example for me to follow ALWAYS !! That means that someone was corrupting her. Were they charged ? YOU HAVE NO IDEA WHAT THIS HAS PUT ME THROUGH !!!! Well i guess my commentary speaks for me. Why not set a good example for everyone else to follow like Brandy did me. Our 16th birthdays are january 29 and Brandy's is march 18. Wendnesday,December 6, 2000 Driver guilty in fatal accident JO DONALDSON Times-News Staff Writer OAKLAND -- An Oakland woman was found guilty in Garrett County District Court on Monday of homicide by motor vehicle while intoxicated. Amanda Lynn Mayle, 20, pleaded guilty to the charge stemming from a July accident that resulted in the death of 15-year-old Brandy April Talhot. Oakland Chief of Police John Sines said this was only the town's second vehicle fatality in 17 years. Mayle was charged in July by officers with the Oakland City Police Department who investigated the single-vehicle accident, assisted by a reconstructionist with the sheriffs office. From field sobriety and blood alcohol tests, officers determined that Mayle was intoxicated at the time. According to Pfc. Shawn Fratz, Mayle's 1991 Buick swerved off the roadway and struck a utility pole on Liberty Street near first street at approximately 3:15 a.m. The vehicle then bounced away from the pole and drifted approximately another block. Mayle was wearing a seat belt, but Talbot. who was a passenger in the front seat, was not belted. Talbot was taken to Garrett County Memorial Hospital and transferred to Ruby Memorial Hospital in Morgantown, W.Va., where she died the next day from Her injuries. Judge Thomas Lohm ordered a presenrence investigarion report. A related DWI charge was merged into the conviction. said State's Attorney Lisa Thayer Welch. The maximum penalty for the charge is five years incarceration and/or a fine of $5,000, according to Welch. |

Brandy didn't get a second chance at life like the person that took hers with only 30 days in jail, 7 months in house arrest, 3 years probation, 50 hours community service, that is all a child is worth in Garrett County it does not justify what she was charged with Vehicular Homicide and DWI. What kind of example are they trying to set for others?I hope and pray that the citizens of Garrett County wake up and smell the roses before another tragedy happens and your child is just a memory too.Brandy had the morals of being a fine young lady and loved by her family and friends.She didn't deserve to die for someone else's stupid mistakes.
